2. Scope and definitions
These Terms and Conditions apply to the bed bug control service supplied by the Provider. They become part of the contract between the parties when an order is placed.
Consumer: a natural person acting outside their trade, self-employed occupation or business. Customer: the consumer or business ordering the service. Treatment: one professional intervention carried out at one address on one occasion.
The Provider reserves the right to amend these Terms unilaterally. An amendment takes effect on publication and does not affect contracts already concluded.
3. Subject of the service
The Provider carries out control of bed bugs (Cimex lectularius) in residential and other properties and, on separate order, in vehicles. The service includes the on-site survey, the application of professionally justified technology, and information after the treatment.
The Provider uses only approved biocidal products, in accordance with their authorisation document and label. The choice of technology (mechanical removal, steam treatment, ULV fogging, crack and crevice treatment, insecticide treatment) is the Provider's professional decision based on what is found on site.
Not included: dismantling and reassembling furniture, cleaning, laundering textiles, removing and disposing of furniture or other items, and repairing structural defects of the building.
4. How the contract is formed
The Customer indicates their request using the callback form on the website, by phone, WhatsApp or e-mail. This is a request for a quote, not yet an order.
The Provider then gives information about the likely price and the work involved. The contract is formed when the parties agree on the time and the content of the service. Agreement may be reached verbally, by phone or in writing.
The price calculator on the website gives an indicative estimate based on the data entered and does not constitute an offer. The final price is set after the on-site survey, once the actual circumstances are known.
5. Prices and payment
The Provider is exempt from VAT under the Hungarian small-business scheme. Prices quoted and invoiced contain no VAT, and no VAT is charged.
Prices are set in Hungarian forints (HUF), and invoicing is always in HUF. Any euro amount shown on the website is indicative only: it is converted at a daily reference rate and does not form part of the contract. The amount payable is always the forint amount.
The price includes the call-out. No separate zone fee or call-out surcharge appears on the website; distance is already included in the total shown.
If a circumstance comes to light on site that materially affects the estimated price (for example more affected rooms or sleeping places than reported, or a significantly different level of infestation), the Provider informs the Customer of the revised price before starting work. The Customer may then withdraw from the order free of charge. Work begins only once the revised price is accepted.
Payment is due after performance, on site in cash or by bank transfer. The Provider issues an invoice for all work carried out.
6. Appointments, cancellation, delay
The appointment is agreed in advance. The Customer may cancel or reschedule free of charge at least 24 hours before the agreed time, by calling or messaging the number given above.
If the Customer cancels later than that, or if at the time of the visit the Provider cannot gain access for reasons attributable to the Customer, the Provider charges a call-out fee of HUF 10,000. This covers the call-out cost actually incurred.
If the Customer requests a new appointment after such a cancellation and the work goes ahead, the Provider may credit this amount against the price of the service.
If the Provider cannot attend at the agreed time, it notifies the Customer without delay and offers a new appointment. No charge applies to the Customer for this.
7. The customer's obligations
The effectiveness of the treatment depends heavily on preparation. The Customer undertakes to:
- carry out the preparation specified in advance by the Provider;
- make the rooms to be treated and the harbourages accessible;
- leave the room for the treatment as instructed by the Provider, and observe the re-entry time;
- not wet-clean the residually treated surfaces for the prescribed period (typically 7 days);
- inform the Provider of any infant, pregnancy, serious illness or allergy in the household, and of any pets, aquarium or terrarium;
- inform the Provider of earlier treatments and the products used.
Failure to prepare materially reduces the effectiveness of the treatment. If the Customer does not carry out the required preparation or observe the aftercare rules, the Provider accepts no liability for the resulting lack of success, and a repeat treatment is chargeable.
8. Performance and the two treatments
Because of the bed bug life cycle, a single intervention is usually not enough: treatment does not reliably act on the eggs. The service therefore normally consists of two visits – the first treatment is followed by a check and follow-up treatment, within a professionally justified window.
The Provider agrees the date of the second visit at the first treatment. A second treatment of the same treated area, carried out within the prescribed window, costs 70% of the price of the first treatment.
This reduced price applies where both visits belong to the same order. If the Customer orders a treatment later because of a new infestation, that counts as a separate order at full price.
For a heavier or more complex infestation the Provider may propose a different treatment plan. The Customer decides whether to accept it.
9. Outcome and liability
The Provider undertakes to carry out the work professionally, not to deliver permanent freedom from bed bugs. Bed bugs can be brought back in at any time – while travelling, with second-hand furniture or luggage, or from a neighbouring flat in a block. This does not depend on the quality of the treatment.
The Provider gives no guarantee of results for bed bug control – neither time-limited nor unlimited. What it undertakes is to carry out the two-visit treatment programme under section 8, professionally and with approved products.
The Provider works in accordance with the applicable professional rules, using approved products as stated on their labels. Its liability extends to professional performance of the work.
The Provider is not liable for:
- lack of success arising from failure to prepare or to observe the aftercare rules;
- damage arising from a circumstance concealed by the Customer;
- renewed infestation resulting from a new introduction;
- any change to the Customer's property about which the Provider warned in advance and which the Customer accepted (for example steam treatment of certain sensitive surfaces).
The Provider is liable for proven damage attributable to it under the rules of the Hungarian Civil Code. Except in cases of intentional breach or breach causing harm to human life, bodily integrity or health, liability is limited to the amount of the fee for the order concerned.
10. Right of withdrawal for consumers
Where the Customer is a consumer and the contract was concluded at a distance (by phone or through the website) or off-premises (at the Customer's home), the consumer may withdraw from the contract within 14 days without giving reasons, under Hungarian Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses.
The withdrawal period runs from the day the contract is concluded. It is enough to send the withdrawal to any of the contact details above before the deadline expires.
If performance falls within the 14 days
If the Customer asks for the treatment to take place before the withdrawal period expires, this requires their express prior request. In that case:
- if the treatment has not yet taken place, the Customer may withdraw and owes nothing;
- if the treatment has been partly performed, the Customer must pay a proportionate amount for what has been performed;
- if the service has been performed in full, the Customer loses the right of withdrawal – under section 29(1)(a) of Government Decree 45/2014. The Provider informs the Customer of this separately before performance begins.
Where withdrawal applies, the Provider refunds any amount due within 14 days at the latest.
11. Complaints and disputes
You can submit a complaint using the contact details above. We examine an oral complaint immediately; we give a substantive reply to a written complaint within 30 days.
If resolving the complaint does not succeed, a consumer may turn to the following bodies:
Consumer Protection Department of the Pest County Government Office
1088 Budapest, József körút 6. · Postal address: 1364 Budapest, Pf. 144.
Pest County Arbitration Board
1055 Budapest, Balassi Bálint utca 25. IV/2., Hungary
Phone: +36 1 792 7881 · E-mail: pmbekelteto@pmkik.hu · panaszrendezes.hu
A consumer may also turn to the arbitration board competent for their own place of residence. Arbitration board proceedings are free of charge.
The Provider has a duty to cooperate in arbitration board proceedings. The Provider has not made a general declaration submitting to the decision of the arbitration board.
The parties will first attempt to settle any dispute out of court. Failing that, the Hungarian court with jurisdiction and competence shall decide the dispute.
12. Other provisions
Matters not regulated in these Terms are governed by Hungarian Act V of 2013 on the Civil Code, Hungarian Act CLV of 1997 on Consumer Protection, Government Decree 45/2014 (II. 26.) and the professional rules applying to public health pest control.
The processing of personal data is set out in the Privacy policy.
If any provision of these Terms becomes invalid, this does not affect the validity of the remaining provisions.
